This Privacy Policy explains how DevNoun LLC d/b/a evabl (“evabl,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you use (a) the evabl mobile application and related services and features (including AI features) and (b) the evabl marketing website at https://evabl.ai (collectively, the “Service”).
If you do not agree with this Privacy Policy, do not use the Service.

1. Scope and Key Definitions
- “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with you or your device.
- “Sensitive Personal Information” may include certain government identifiers, precise geolocation, health information, or other categories defined by applicable law. We do not intentionally request sensitive data in the Service unless clearly needed for a specific feature and disclosed at collection.
- “User Content” means the content you provide to the Service (for example: goals, notes, prompts, messages, and other inputs).
- “AI Output” means content generated by AI features based on inputs (which may be inaccurate or incomplete).
This Privacy Policy applies to information collected online through the Service and through our marketing efforts connected to the Service.
2. Eligibility and Children’s Privacy (18+)
The Service is intended for individuals 18 years of age or older. We do not knowingly collect Personal Information from anyone under 18. If you believe a minor has provided us Personal Information, contact us at hi@evabl.ai and we will take steps to delete it as appropriate.
3. Information We Collect
3.1 Information You Provide
We may collect:
- Account and profile information: name, email address, phone number, and other registration details.
- User Content: goals, notes, messages, prompts, and other information you enter into the Service.
- Support and communications: information you provide when contacting us (including email, phone, or in-app support).
- Marketing preferences and consents: opt-in/opt-out choices for emails, SMS, calls, and push notifications.
- Payment-related information: if you purchase through the App Store or Google Play, we receive purchase/entitlement signals and basic transaction metadata (we do not receive your full payment card number from those platforms). If we offer web-based payment, our payment processor may collect payment details directly.
3.2 Information Collected Automatically
We may collect:
- Device and usage data: device type, operating system, app version, language, time zone, session activity, in-app events, crash logs, performance data, and diagnostics.
- Identifiers: device identifiers and advertising identifiers (where permitted), and related attribution data.
- Log data: IP address, browser type, referral URLs, pages viewed, and timestamps.
- Approximate location: inferred from IP address (e.g., city/state). We do not need precise GPS location for core functionality unless explicitly disclosed at collection and enabled by you.
3.3 Cookies, Pixels, and SDKs
Our website and app may use cookies, pixels, and SDKs to:
- keep you signed in (where applicable),
- remember preferences,
- understand usage and improve performance,
- measure marketing effectiveness and attribution,
- help prevent fraud and abuse.
Some of these technologies are provided by third parties (see Section 6).
4. How We Use Information
We use Personal Information to:
- Provide and operate the Service (including account creation, subscriptions, and core app features).
- Provide AI features (processing your inputs to generate AI Output and provide goal-planning assistance).
- Improve and develop the Service (including analytics, debugging, testing, research, and feature development).
- Customer support (responding to questions, troubleshooting, and user requests).
- Security and fraud prevention (monitoring, detecting, and preventing malicious, deceptive, or illegal activity).
- Marketing and communications:
- send service-related messages (e.g., security alerts, updates, receipts);
- send promotional messages via email, push notifications, SMS/text, phone calls, voicemail, in-app messages, and other channels you provide or enable, subject to applicable law and your choices/consents.
- Measure marketing performance (conversion tracking, attribution, audience measurement, and campaign reporting).
- Legal compliance and enforcement (comply with law, protect rights and safety, and enforce our terms).
5. AI Processing and Model Improvement
5.1 Processing for AI Features
To provide AI features, we must process User Content (including prompts and goals). This may involve:
- automated processing to generate AI Output,
- storing inputs and outputs to maintain app functionality (e.g., saving goals, history, and context as part of the Service).
5.2 Use of Content to Improve the Service
We may use User Content, usage data, and feedback to improve the Service, including AI features. Where feasible, we may use aggregated or de-identified information for analytics and improvement.
5.3 Third-Party AI Providers
We may use third-party AI infrastructure/providers to deliver AI features. When we do, we may transmit necessary data (including your inputs) to those providers to generate AI Output and operate the Service. We take steps designed to limit disclosures to what is necessary and to require appropriate safeguards.
5.4 Your Choices
If we offer settings or mechanisms to limit certain AI-related uses (for example, limiting retention of AI prompts/history or limiting use for improvement), we will honor those choices where reasonably available. You may also contact us at hi@evabl.ai with requests described in Section 10.
6. How We Share Information
We may share information in the following situations:
6.1 Service Providers and Vendors
We share information with vendors who help us operate the Service, such as:
- cloud hosting and storage,
- analytics and performance monitoring,
- customer support tooling,
- marketing measurement and attribution,
- communications providers (email, SMS, push),
- payment processing (if web payments are offered),
- AI infrastructure/providers.
These vendors may access information only to perform services for us and are required to protect it consistent with their role.
6.2 App Stores and Platforms
If you access the Service via Apple or Google, your use may also be subject to those platforms’ terms and privacy practices, and they may collect information independently.
6.3 Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, we may transfer information as part of that transaction, subject to standard confidentiality protections.
6.4 Legal and Safety
We may disclose information if we believe in good faith that it is necessary to:
- comply with law, legal process, or lawful requests,
- protect the rights, safety, and security of users, DevNoun/evabl, or the public,
- prevent fraud or address security issues.
6.5 With Your Direction or Consent
We may share information when you direct us to do so or when you otherwise consent.
7. Marketing, Tracking, and Targeted Advertising
We use marketing analytics and measurement to understand what works (for example, which ads lead to installs or subscriptions). Depending on configuration and applicable law, certain partners may collect data via cookies/SDKs for:
- analytics,
- attribution,
- advertising measurement,
- (in some cases) interest-based advertising.
Your controls may include:
- cookie controls on the website (where provided),
- device-level settings for ad tracking/advertising identifiers,
- email unsubscribe links,
- SMS opt-out by replying STOP (or another supported method),
- push notification settings on your device.
We do not guarantee that all tracking can be disabled in all environments; however, we strive to honor legally required opt-outs.
8. Data Retention
We retain Personal Information for as long as reasonably necessary to:
- provide the Service,
- comply with legal obligations,
- resolve disputes, and
- enforce agreements.
Retention periods vary based on the type of information, why we collected it, and legal requirements. We may retain and use aggregated or de-identified information for longer periods.
9. Security
We implement administrative, technical, and physical safeguards designed to protect information. However, no system is completely secure. You use the Service at your own risk, and you are responsible for using strong passwords and protecting your account credentials.
10. Your Privacy Rights and Choices
Your rights depend on where you live.
10.1 Account Information
You may be able to access, update, or correct certain information through the Service. You can also contact us at hi@evabl.ai.
10.2 Deletion Requests
You may request deletion of certain Personal Information by contacting hi@evabl.ai. We may need to retain certain information for legal, security, or operational reasons.
10.3 Marketing Opt-Outs
You can opt out of marketing communications:
- Email: use unsubscribe links or email hi@evabl.ai
- SMS: reply STOP (or another supported opt-out method)
- Push notifications: disable in device settings (and/or in-app settings if available)
Service/transactional communications may still be sent.
10.4 Nevada Privacy (Sale Opt-Out)
If you are a Nevada resident, you may have the right to opt out of the “sale” of certain covered information. To submit a verified request, contact hi@evabl.ai with the subject line “Nevada Opt-Out Request” and include sufficient information for us to verify your identity.
10.5 California Privacy Rights (CCPA/CPRA)
If you are a California resident, you may have rights to:
- know/access the Personal Information we collect, use, and disclose;
- delete Personal Information (with exceptions);
- correct inaccurate Personal Information;
- opt out of “selling” or “sharing” Personal Information (as defined by California law);
- limit certain uses/disclosures of Sensitive Personal Information (if applicable);
- not be discriminated against for exercising these rights.
Submitting Requests: Email hi@evabl.ai with the subject line “California Privacy Request.” We will verify your request as required by law. You may authorize an agent to act on your behalf, subject to verification.
Do Not Sell or Share: If we engage in practices that constitute a “sale” or “share” under California law (for example, certain cross-context behavioral advertising/targeted advertising), you may opt out by contacting hi@evabl.ai or using in-product controls if we provide them.
10.6 Other U.S. State Privacy Laws / International Rights
Depending on your location, you may have additional rights (such as access, deletion, correction, and opt-out of targeted advertising). If you are in the EEA/UK or other jurisdictions with data protection laws, you may have rights including access, deletion, restriction, objection, portability, and withdrawal of consent where processing is based on consent.

11. International Data Transfers
We are based in the United States. If you access the Service from outside the U.S., your information may be processed and stored in the U.S. and other locations where we or our service providers operate. We take steps designed to protect information transferred internationally as required by applicable law.
12. Third-Party Links and Services
The Service may link to third-party websites or services. We are not responsible for their privacy practices. Review their privacy policies before providing information to them.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will change the “Last Updated” date above, and if changes are material we will provide notice as required by law (for example, via the Service or email). Your continued use of the Service after an update means you accept the updated Privacy Policy.
